User Agreement for Travel to Mongolia

Organization: The organization of these grand journeys has been carried out by Samar Magic Tours (SMT) LLC, located in Ulaanbaatar 15160, P.O. Box 2567, Peace Ave., Bldg. No. 3, Apt. No. 18, Mongolia. We are the First and Only Inbound Agency with local Spanish-speaking guides (Castilian/Spanish), and also with local English-speaking guides License No. 2111047 and INTO 905.

Price: The price of our tours has been calculated based on exchange rates, transportation fares, fuel costs, and applicable fees and taxes on the date of publication of the program/brochure or subsequent editions, if any, released in printed form. Any variation in these elements may result in a revision of the final price of the tour, either upward or downward, in the exact amounts of the referenced changes

These modifications will be notified to the customer in writing or through any medium that allows proof of communication. If the modification is significant, the customer may either withdraw from the trip without penalty or accept the contract modification.

Under no circumstances will an increase be applied within twenty days prior to the departure date of the trip for already confirmed bookings. Prices are calculated on the basis of double occupancy.

Cancellations and Refunds:

Withdrawal by the consumer, tour cancellations due to not reaching the minimum number of registered participants: At any time, the user or consumer may withdraw from the services requested or contracted, being entitled to a refund of the amounts paid, whether the total price or the deposit indicated in the previous section, but must compensate the Agency for the following:

Cancellations of land tours:

  • Deposits are non-refundable.

  • 60–19 days prior: 50%

  • 18–00 days prior: 100% – NO REFUND.

In the case of cancellations of airline or train tickets:

This is treated separately. Air and train fares, both international and domestic, are subject to modifications depending on availability at the time of booking. Air and train fares are only guaranteed upon issuance and full payment of the tickets. Tickets are non-refundable and can only be cancelled on the same day of issuance.

No compensation will be due in the following cases:

  • When cancellation is due to the number of participants being lower than required, communicated to the consumer in writing before the deadline specified in the contract.

  • When the cancellation of the trip, except in cases of overbooking, is due to force majeure, meaning circumstances beyond control, abnormal and unforeseeable, whose consequences could not have been avoided despite due diligence.
  • Domestic Flights: Domestic flights sometimes undergo changes, delays, or cancellations, sometimes without prior notice. In such cases, we will do everything possible to find the best available solution; however, no claims will be accepted for consequences such as road travel, loss of visits, or free time, and no refund will be provided.
  • Travel Agency: Reserves the right to modify the order of the itinerary, accommodations, and means of transport once at the destination, without this entailing any refund.
  • Accommodation outside the capital: Lodging is in traditional tourist camps in Gers, the typical dwellings of the nomads, spacious and adapted for tourists. Sometimes in tourist Gers camps, electricity is cut off after 10 or 12 at night. In all Ger camps, bathrooms and facilities are located far from the Gers, especially inconvenient at night. If you wish to stay in a DELUXE Ger with a private bathroom in the Gobi Desert or in Karakorum, a supplement indicated in the price table must be added. In the rest of the itinerary through Mongolia’s countryside, there are no DELUXE Gers with private bathrooms.
  • Roads, tracks, and highways: Infrastructure is still under development. Distances are vast, with long travel hours between destinations and high fuel expenses. In these cases, we will do everything possible to find the best available solution; however, no claims will be accepted for consequences such as road travel, loss of visits, or free time, and no refund will be provided.
  • Transportation: On tours, buses may vary in type depending on the number of participants. If the group does not reach sufficient numbers, a minibus or van may be used. Unless otherwise specified, such vehicles do not have reclining seats. Transport within national parks for photo safaris is carried out in vans or 4×4 vehicles typical of the country. In all cases, the design, structure, comfort, and safety standards of the transport vehicles may not correspond to Spanish norms but to those of the destination country. SMT reserves the right to change transport means at the destination without this entailing any refund.
  • Weather conditions and climate changes: These are not included in our services. Such circumstances are beyond control. In such cases, we will do everything possible to find the best available solution; however, no claims will be accepted for consequences such as temperature changes, and no refund will be provided.
  • Hotels: Rooms will be available from 2:00 PM on the day of arrival and must be vacated by 12:00 noon on the day of departure.
  • Responsibility: Samar Magic Tours (SMT) undertakes to carry out all services contained in the contracted program, whether by the company itself or by other service providers—without prejudice to SMT’s right to take action against such providers—and always within the limits established by applicable law. SMT is exempt from liability when defects in service execution are attributable to the customer or when caused by force majeure, i.e., abnormal, unforeseeable circumstances whose consequences could not have been avoided despite due diligence; or when defects are due to an event that SMT could neither foresee nor overcome. SMT is not responsible for accommodation, meals, transportation, or other expenses caused by delays in departures or returns of transport due to weather, technical issues, strikes, or another force majeure. Regarding luggage, SMT is not responsible for any damage or deterioration it may suffer during the trip. In such cases, we will do everything possible to find the best available solution; however, no claims will be accepted for lost luggage.
  • Samar Magic Tours (SMT) undertakes to carry out all services contained in the contracted program, whether by the company itself or by other service providers—without prejudice to SMT’s right to take action against such providers—and always within the limits established by applicable law.
  • Photos: All photos are the property of Samar Magic Tours (SMT). They may be used for publicity purposes only when working with Samar Magic Tours. Our photos are strictly prohibited from being used for publicity in collaboration with other Mongolian tour operators.

Conclusion: If any breach occurs in the execution of the contract, you must report it preferably on-site, or otherwise as soon as possible in writing, or by any other method that provides proof, to Samar Magic Tours.
